As your constituent, I write in strong opposition to the Food Security and Farm Protection Act (S.1326) introduced by Senator Ernst. S. 1326 overrides the will of voters and would give factory farm polluters free rein to harm families, farmers, and communities. Please reject this bill and the inclusion of any legislative text resembling the former EATS Act in the Farm Bill.

The Food Security and Farm Protection Act includes language that mirrors the EATS (Ending Agricultural Trade Suppression) Act, legislation that failed to pass in prior sessions because it threatened to remove protections of voter and state rights, agricultural workers, consumer food safety, and natural resources. The EATS Act and similar policies have generated overwhelming opposition from a diverse set of more than 170 groups, plus hundreds of federal and state legislators, individual farmers, veterinary professionals, faith leaders, and legal experts.

This bill threatens longstanding food safety laws, including ones that regulate chemicals in baby food, prevent dangerous pesticide use, prohibit child labor, and ensure animal welfare and environmental protection.

S.1326 goes against state decisions, bipartisan consensus, and previous Supreme Court rulings. Fourteen states limit the intensive confinement of farm animals, and family farmers across the country have made significant investments to comply with state laws that could be undone with this bill. Eight in ten American voters, including nearly equal numbers of Republicans and Democrats, support bans on cruel confinement being enacted in their own states. In 2023, the Supreme Court ruled in favor of California’s Proposition 12, a law addressing animal welfare and public health risks caused by the extreme confinement of animals in factory farms. Congress should listen to the will of voters and courts, not factory farm lobbyists.

The dangerous and undemocratic Food Security and Farm Protection Act must be stopped. I urge you to advocate against this bill in all of its forms and protect voters, states’ rights, and animals in the Farm Bill.
